Land Use & Zoning Law

Some of the most contentious debates in the local government arena center about the government’s police power to regulate the use of land. An extensive body of complex and constantly changing regulations, laws and judicial opinions have grown out of competing interests that the government, landowners, developers and "interested" third parties have in the use of a piece of dirt. There are a myriad of agencies, boards, councils, and commissions established to carry out this regulation of private property.

Practicing "Land Use & Zoning Law" requires comprehensive understanding of the legal, political and planning aspects regulating the development or redevelopment of property as a new, different or expanded use as well as the ability to resolve disputes amongst competing public, private and third party interests.

The legal, political and planning knowledge and experience acquired over 20 years together informs Deborah’s advice to her clients as she navigates the land use and zoning maze on a clear path that positions the client to achieve community consensus and all of the necessary regulatory approvals. Professional services include client advocacy before key decision makers at all levels of government and in any appeals arising from the process.

Appellate Advocacy

Occasionally, despite best efforts at consensus building amongst competing interests, litigation is unavoidable. Having the same lawyer representing the client before the governmental body and the administrative or judicial appellate forum allows an efficient continuum of representation.

Representing clients at all levels of state court has provided Deborah an in-depth understanding of the record evidence needed not only to build a compelling case for various zoning approvals but also necessary to protect and defend the client’s interests in the event of an appeal.

Real Property Law

Practicing "Real Property Law" is more than preparing a simple contract in most cases in today's complex world of government regulation of land and highly competitive economic and political environment.

In addition to traditional residential and commercial real property services, clients receive an in-depth understanding of the government regulations and private deed and lease restrictions that impact the use of the property they want to buy, sell, develop, use or lease.

Whether the client is a buyer, seller, landlord, tenant, owner or investor, understanding these regulations and restrictions and if they can be changed to achieve the desired use is essential.

Community Association Law

Practicing "Community Association Law" in essence is the creation and operation of a "mini" government for residential, mixed use and commercial developments in the form of condominium or homeowner’s associations.

The Firm represents developers from project conception, creation to completion, including document preparation, sales, and turnover of the Association. The Firm also counsels and provides legal services to Boards to ensure operation of their Association in compliance with governing state laws and Association documents, including amendments, enforcement, and dispute resolution.
